1. Agreement

These Terms of Service ("Terms") govern your use of the hosting, cloud (VPS), and bare metal services ("Services") provided by EIVUS ("Company", "we", "us"). By placing an order or using our Services, you agree to these Terms. If you do not agree, do not use our Services.

2. Services

We provide virtual private server (VPS) and bare metal hosting in tier-III data centers. Service levels, uptime, and support are as described on our website and in your order. We reserve the right to modify or discontinue Services with reasonable notice when possible.

3. Acceptable Use

You agree to use the Services only for lawful purposes. You may not use our infrastructure for illegal activity, malware distribution, spam, denial-of-service attacks, or any use that violates applicable law or harms others. We may suspend or terminate access for violations.

4. Payment

Fees are billed in advance according to your plan. Payment is due as specified (e.g., monthly or annually). We use Stripe for payment processing. Failure to pay may result in suspension or termination of Services. Refunds are subject to our refund policy stated at the time of purchase.

5. Data and Privacy

You are responsible for your data. We process personal data in accordance with our privacy practices and applicable law. By using our Services you acknowledge our data processing as necessary to provide the Services.

6. Limitation of Liability

To the maximum extent permitted by law, EIVUS shall not be liable for indirect, incidental, special, or consequential damages, or for loss of data or profits arising from the use or inability to use the Services. Our total liability is limited to the fees you paid us in the twelve (12) months preceding the claim.

7. Termination

You may cancel Services in accordance with your plan terms. We may suspend or terminate Services for breach of these Terms, non-payment, or to protect our network and users. Upon termination, your right to use the Services ceases immediately.

8. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
